AGREEMENT TO TERMS: These Terms and Conditions constitute a legally binding agreement made between you ("you," "user") and tapin.now Inc. ("we," "us," or "our"). By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

By creating an account, accessing, or using tapin.now services (the "Service" or "Services"), you acknowledge that you have read, understood, and agree to be bound by:

2. Eligibility and Account Registration

2.1 Strict Age Requirements (COPPA & GDPR)

BY USING THIS SERVICE, YOU REPRESENT AND WARRANT THAT:

tapin.now provides a platform to create profile pages. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

4. User Content and Conduct

4.1 User Content

"User Content" means any text, graphics, images, music, software, audio, video, information or other materials that you upload, post, or display.

4.2 Content Responsibilities

You are solely responsible for your User Content. You represent and warrant that you own all rights to your User Content or have obtained all necessary permissions.

4.3 Prohibited Content

You agree NOT to post User Content that:

  • Is illegal, threatening, harassing, defamatory, or libelous
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or malicious code
  • Promotes illegal activities, scams, or fraud
  • Contains sexually explicit content involving minors or non-consensual sexual content

4.4 Monitoring and Enforcement

WE RESERVE THE RIGHT TO REMOVE, DELETE, OR BLOCK ANY USER CONTENT (INCLUDING IMAGES, LINKS, AND PROFILE TEXT) AT ANY TIME, FOR ANY REASON, WITHOUT PRIOR NOTICE TO YOU, AND WITHOUT ANY LIABILITY.

5. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of tapin.now and its licensors.

6. DMCA Copyright Policy

Safe Harbor Notice: We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected], with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged Infringement as detailed under 17 U.S.C. 512(c)(3).

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through the Service on your copyright.

Our Service contains links to third-party web sites or services that are not owned or controlled by tapin.now.

WE HAVE NO CONTROL OVER THIRD-PARTY CONTENT: tapin.now has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that tapin.now shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK.

8.2 Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE.

10. Termination & Suspension

WE RESERVE THE RIGHT TO TERMINATE YOUR ACCESS:

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account via the dashboard.

11. Dispute Resolution

Any dispute related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States. YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
